An agreement about automatic renewal might be founded as non-expectable provision,
because the provision is placed only in contractual terms, not in the body of a contract. Non-expectable provision is usually not legally binding for a consumer. This point of view is supported by the case-law of Supreme Court of Czech rep (sp. zn. Cpjn 200/2013).
Consumer could also claim a misrepresentation, because he was not informed about the price of the service. Company always has to enlighten consumer about the price of the products or services.
Consumer should contact a company and make a statement, that he was not informed about a terms and conditions and that the provision about automatic renewal is not legally binding for him (due to misrepresentation).
